Buying a home and don't know how anything works

You are right Riklet. But sometimes I work myself up into a state of anxiety that's exaggerated. So just need to think rationally and stay out of scary guy's way (rooms have a lock).
 
miss direct you hopefully now appreciate the nagging at you over recent weeks to chase, chase hard, throw tantrums or whatever....go do it.

If you are scared in your own house and having to lock doors etc sounds like time to go. Have a look on airbnb gumtree spare rooms etc... you can just go! You don't have a deposit right?

I was living with my parents until a week ago, was scared and anxious about moving and being independent again (due to long covid etc) but ive managed it fine. You wont regret it when youre in a new place in a week, even if youre a few hundred quid out of pocket. You can even leave most of your stuff... you're paying for the room!

Dont let the current mess make you walk away from the flat deal. Things will work out.
 
I've woken up and made a decision today. Rent is due - I will pay it and give my one month's notice. This time in a month, I will either be in my new place, about to move in (in which case I will either negotiate another week or so here or if necessary move to a friend's temporarily) or if this crap is still dragging on, I will pull out of the sale and rent my own place.

(I've been having some issues with the shared house over the last few days that have made me feel really anxious - this is the right decision for me.)

That sounds like a really sensible and well timed decision to me. X
Means you can get rid of the stress and worry over extending rent (and convos around that) and more importantly, that you have an end date set re the stressful place you are now, particularly around you feeling safe :mad: :(
I definitely wouldn't think of it as a pulling out situation, either!
I know it doesn't feel like it but this has not been a weirdly long time to purchase - and you are so nearly there with all the searches arriving back.
If you pass anything on (to the EA and your solicitor), it can just be that - that your current living arrangements are intolerable and you have now served notice, but with a preference to be out asap.

Hold on to this, cos you are just being wise in reducing all the potential stress now, as far as you can 'This time in a month, I will either be in my new place, about to move in (in which case I will either negotiate another week or so here or if necessary move to a friend's temporarily)'. Won't be long now! :) X

Sorry. I have been hear trying to offer the benefit of my experience from very early on in this thread. I have tried to make lots of my thoughts open
to anyone reading through this thread and helpful to them. I have tried to only be pedantic, when the need has arisen to point out differences between conveyancers and solicitors, the difference between a full structural survey and a home buyers report, because I think it's important. I have even been called out (harshly in my opinion) for suggesting a chase be made by telephone!

I really really hope that miss direct proceeds to exchange and completion as soon as possible, I really do and I will be happy to contribute to a house warming present.

Hindsight is a wonderful thing, but I do hope that even if just one person, not necessarily miss direct even has seen something useful in just
one person of mine then great, but if not, nothing has been lost, at least I hope not.
 
I appreciate all the people replying, helping me get through it. I know I am crap with confrontations and the telephone and this reluctance does work against me sometimes.

I won't be moving out of this place immediately, but I do have a friend's I can go to if I really need to. She has a spare room...it's just very small and they smoke indoors, which bothers me. But if I feel unsafe or have any serious issues with the guy here I won't hesitate to go there. He's a twonk but I doubt that he's really capable of hitting me or anything.
 
I emailed the estate agent to nudge/remind her to chase seller's solicitors, which she said she would be doing today. She's quite good at reading and responding now, thankfully, as I am teaching all day and it's hard to answer phone. There really doesn't seem any point in me contacting my own solicitors until they actually have the missing responses from the other party. If she's not answered by tomorrow morning I will call (I did buy some credit, one step at a time!)

Oh and I've given my notice in on the current place :thumbs:

Ok so maybe something good came out of today. Estate agent has informed solicitor that I need to complete this month and believes its possible. Maybe this will give them the boot up the bum they so clearly need?

(And my landlord asked if I was moving on the 8th July so that actually gives me another week)

It gives your solicitor the necessary nudge to also nudge the sellers solicitor. Once the sellers solicitor realises they have the estate agent/your solicitor and hopefully your sellers (which the estate agent should be advising them to do) harassing them for missing something, then they will actually do it to get everyone off their back.

I know there's been some push back on being advised to harass, but seriously it's the only way to make things move quicker when you're at this stage. it's all in the hands of solicitors now, they are not waiting for anything, 'just get it done!!' should be the message from every possible approach.

My property headache continues, sellers are going to remarket if not completed by 16th June

I asked for an update from my solicitor and got

I emailed the solicitors over the weekend and also sent the searches off to the lender’s solicitors – am wating to hear back on both.

So very much how longs a piece of string.

it’s getting a bit tedious. The solicitor sent a threatening email last week asking for my ID documents......I pointed out they had been sent in February.... then demanded an up to date bill with my address on that I have no access to as I’m offshore...they finally accepted a pdf water bill.

solicitor emailed back apologising for the pugilistic/punitive flavour of his threatening letter saying it’s just a template they use...

got extorted for another 8k by the vendor and I just don’t feel like this will ever complete.

problem is my whole financial situation has changed from the position I was in at the start of this process 7 months ago . Having changed jobs and roles my income has dropped and this will effect affordablility parameters in any new mortgage process if this shit fails

anyways I’m back home tomorrow so hopefully shit will start moving

Have they sent you the contracts yet? Push for that if not. There’s no reason for you to not have signed them. Solicitors date them so it’s not as if it has to be right at the end. You can’t even exchange if no signed contracts in hands of solicitors.
 
I have missed the last several pages, sorry, so this might have been covered, but I note a number of messages about contract and transfer notice (TR1) signing, which I think have not happened yet?

Both of these can be done electronically (eg by docusign) via email and phone, neither require a physical presence or to be physically posted back and forth. I think Land Registry waived the wet ink requirement due to the COVID situation.

It might be worth asking your solicitor if they are set up to facilitate that - it adds flexibility and removes some sources of potential delay.

You will still need someone physically in the room with you to witness you pressing the ‘sign’ button on the TR1 so they can press a ‘sign’ button to confirm they saw you pressing yours :) The contract doesn’t require witnessing.

I would be inclined to phone. Electronic communication is easily put to the bottom of the pile or ignored.

Ok so really stupid question here. When I call my solicitor, which is a huge firm, do I ask to speak to the actual solicitor or the clerk dealing with my sale?

Ask for who is dealing with your case.

An email CC'ing everyone's contact details you know of though will hopefully help too, as everyone will see you are trying, especially if using the phone is difficult because of teaching commitments. At one stage I had an email chain going with me, my buyer, seller, estate agent and solicitors. My solicitor was pretty good to be fair and would reply within a couple of hours or phone and would chase my sellers solicitor, as would the estate agent. As they were shite.

However by sounds of things you also still have paperwork to complete. Ask for the contract and the TR1 (not sure if a TR1 is involved with flats as assume council own the land, there may be another form in it's place or nothing) so you're then not waiting for these to be sent to you and back off.

TR1s are used for leasehold as well as freehold property, just for completeness, so you will be signing a TR1.

You do not need to be, no.

You will need to sign the contract and transfer notice (this latter requiring a physically present witness - anyone over the age of 18 will do, you don’t have to know them). This can be done by post/courier (for which at least you’ll need a postal address), or as I mention above by docusign or similar electronic signing, if your solicitor is set up for it.

You don’t need to be physically present to collect the keys on completion day either - the estate agent can hang on to them (I have done this), or you can forget them altogether - once the forms are signed and the money transferred the place is yours - you only need the keys so you don’t have to kick the door down to get in! There’s nothing magical about them :)

We usually wait for all enquiries to be answered before sending this out. When are you going away?"

Ask for a copy of that correspondence. Ask to be copied into all emails (bcc if they prefer).

If you want to speed this up I’m afraid you need to drive this yourself. You need to understand where the delay is happening and you need to apply pressure to your solicitor and to the vendors to speed up.

If you politely and firmly make a nuisance of yourself then the solicitor will put your case to the top of the pile. The squeakiest door gets oiled.
 
They're not telling me end of the month exactly. I told them I have to leave my temporary accommodation, need completion be done by the end of the month and what can be done to speed things up.
