Peter Dow's political defence -v- "criminal tweets" charge

Members of the jury, how do you find the defendent, guilty or not guilty?

I think he is seeking a board with legal skills to assist him in his campaign to clear his name. I can only assume that Diamond's legal advice was not sufficient!
:)

But not the full address, surely?

Its pretty normal in Scottish courts, yes - there are only a small range of crimes that get automatic anonymity. Beyond that withholding is decided on an individual case basis for safety/harassment/public interest reasons but Peter himself had put his address in the public sphere a few years back.

His window display is a well known thing in Aberdeen.

Can you give him a knock when you're passing and pass on our best wishes for us. Ta

It's in fact also celebrated in the Border ballad "Wha' Widnae Kna His Windae" (Child 106)

His name doesn't seem to be on the court roll, anymore. Maybe it was moved to another day...

"Dow denies the charge against him and was due to go on trial at Aberdeen Sheriff Court tomorrow.
His trial has now been adjourned until February due to clashes in the court’s timetables."
- Press and Journal, 3rd November 2015

23rd February 2016 to be precise.

I do urgently want my computer equipment which holds my irreplaceable science research and development data returned to me from the police, which the police won't do without permission from the prosecutors that my property is not needed as "evidence", as I explained to the First Minister of Scotland, Nicola Sturgeon when she visited Aberdeen in February 2015.

I am making a counter-charge against the state of a CRIME AGAINST HUMANITY, as I explain in my political defence blog.

"A CRIME AGAINST HUMANITY
To interrupt my scientific duties and service to humanity with a police raid and court action amounts to the state harming the public interest and committing a crime against humanity.

No state and no officer of the state should ever dare to obstruct what even one scientist can do for the prosperity of the people and for the benefit of humanity because there can be no "state immunity" for crimes against humanity, as the Nuremberg Trials demonstrated."

However, my urgent demand for the return of my scientific data does not mean that I wanted the trial to go ahead on 4th November.

As a republican, I never want any case of mine to go to trial before HM's courts, especially this case where there is an attempt to criminalise my republican political activity.

As I also say in my political defence blog

"NO JUSTICE FOR REPUBLICANS IN QUEEN'S COURTS
I have been victimized, traumatised and offended against in this case and in other cases before this one, by what the sadistic and vindictive police, prosecutors, courts and prisons have unjustly and illegally done to me when, as a good man with a keen social conscience, I have bravely tried to do my duty to my neighbours, my community, my home city of Aberdeen and my country of Scotland and suffered arrests and imprisonment for my good deeds.

There is a saying "no good deed goes unpunished". Indeed, it does seem to be true anyway that no good deed by a republican goes unpunished by a Queen's court.

So I admit no "previous convictions". I admit only previous miscarriages of justice and wrongs done to me at the heavy hands of the Queen's courts' officials.

So I don't expect that there will be a fair trial for me, nor for any republican, in any unjust royalist kangaroo court of this kingdom, where judges, who serve the Queen but not the people, will be sitting in judgement on republicans, who serve the people but not the Queen.

Therefore in the unfair show trial on 23rd February 2016 I will be appearing before another royalist court which can so easily do a wrong to me, especially if such court-wrong-doing is thought by wrong-doing royalists to serve their Queen.

I believe that there can be

  • courts which serve the people and do what is right and just, or,
  • courts which serve the Queen and do what is wrong and unjust
but, in my republican opinion, there cannot be such a thing as"a court which serves the Queen and the people and does what is right and just, all at the same time".

In serving the Queen, royalist judges often

  • follow misleading evidence lead by "the Crown" - the prosecutors
  • defer to the kingdom's fallible authorities
  • have contempt for human rights law
  • dish out cruel punishments for trivial or minor offences
and so do wrong to the accused and a disservice to the people and therefore it is time to end the status quo of royalist courts, pretending to be "courts of justice" which royalist courts realistically can never be.

No doubt my lawyer will do his best on the day but I believe that my best political defence can only be published by myself, in my blog, in emails and in press releases."
So I value my trial-by-media, in the court of public opinion, in forums such as Urban75, much more than the pending trial in HM's kangaroo courts.

Talking about Messiahs ...
Good luck Peter Dow!

We the people salute your courage and indefatigability in the face of this outrage.

Could you make it clear what it is you want us not to post - maybe by use of a few illustrative examples?

What I meant dear trolls, is that forum administrators may be monarchs of their forums but they can't stop themselves or their forum members from being arrested by the police in the real world.

That was my point and to imply anything else is the implication of a troll.

That seems to imply that you're implying that anyone who implies the implication of a troll is implying something.

That's quite trollish, too. In an implied way... :)

No don't anyone dare knock my window "when you're passing".

I suffered nearly three weeks in prison and a life-time of post-traumatic stress because of drunks, yobs and assorted scum banging on my window when after I complained to the police - instead of helping me, the victim of harassment - the police arrested me!

"These anti-social clowns had been attracted it seems to my window because I had displayed posters in my window explaining my political views, that I felt and still feel are urgently in need of expressing. (This was in the days when unemployed people like myself were being denied access to the internet by Aberdeen College and neither was there at that time Aberdeen City Library internet access to the extent that there is now.)

I was extremely reluctant to go to the police to complain about the anti-social window-bangers as I have many very bad experiences at the hands of the police, including being tortured and imprisoned for simply distributing political leaflets.

Indeed the fact that the police were denying me the right to distribute leaflets freely made my political window display all the more important to me.

But eventually, one day, I was so infuriated by the banging that was disturbing my studying that I went to complain at the local police station.

The police officers there on the day, Gardener and Mackin, advised me to take my posters down out of the window and I replied angrily that they were “typical useless police bastards”.

Now some people, the police mainly, believe that swearing at the police is an offence. I take the view that in a free country, one should be entitled to swear at the police for being useless if that is what you think they are.

If the police are stopping it being a free country by arresting people who swear at them then I think it is the police who are offending against freedom and the rights of the citizen and so the police state should be resisted.

Anyway, Gardener and Mackin decided to detain and arrest me and there was a struggle before I was handcuffed and taken in the police van to Queen Street police station. In the back of the police van, I was tortured by Gardener unnecessarily tightening the handcuffs after I asked him to slacken them a bit as they were already too tight. Both Gardener and Mackin laughed as I squealed in pain.

So that was the nature of my so-called crime - I was a dedicated student, wishing to help medical science and only wanting to study in peace while maintaining posters in my window and I had dared to express anger at the failure of the police to prevent my peace from being breached.

Rather than stop the anti-social individuals who were disturbing my peace, it was the police’s decision just to trump up a breach of the peace charge against me.

I had quite rightly sworn at a couple of useless police officers and had understandably enough resisted being arrested for that non-offence.

I chose to represent myself in court - a decision that I would come to regret.

As a republican, defending myself in court, I had taken the principled position not to raise my hand in the witness box so as not to be seen to give undue respect to a royalist judge, Sheriff Colin Harris.

Harris could not understand this and rather than try to get his tiny, little brain around my political stance, he ordered my detention by the police for an hour or two while he thought about it, got me a lawyer, and then he imposed a bail condition that I be required to have a psychiatric examination.

I was initially released on bail but when it became evident that I would only agree to meet the court-appointed psychiatrist at a non-medical premises, such as at a lawyers’ office or at the court building, and the psychiatrist wouldn’t co-operate with my reasonable request, Harris revoked the bail and ordered me imprisoned on remand for three weeks in the remand wing of the local prison Craiginches (so that the psychiatrist could examine me in the medical room of the prison.)"

I should also point out then when hand-cuffed and pinned face down on the ground by police officers, another police officer held a knife to my face to threaten me with cutting the throat strap off the motor cycle helmet I was wearing, to terrorize me not to struggle while his fellow officer unbuckled the strap. I was wearing the motor cycle helmet for protection because of previous traumatic injuries I had suffered while resisting arrest by the police for giving out a political leaflet.

Genuine visitors to my home may need to tap my window to get my attention (because my front door buzzer does not work) but "banging while passing" is very stressful.

I have subsequently to those events installed three video cameras in my window connected to CCTV monitors so I can see trouble-makers coming now and so I get less of a shock when they do bang. I have also disconnected the alarm, which was of no use since the police refused to respond to the alarm except to threaten to confiscate the alarm and so the alarm only attracted those who wanted to set it off safe in the knowledge that the police would do nothing.

How long have you been unemployed ?
And why ? - given you have a university degree ?
Without wanting to be rude to the educated gentleman, I think you only have to read the screed he posted previously to see why an employer might be a bit hesitant about taking him on. I haven't really studied his beliefs that closely, and the way he presents his arguments has a lot to do with that - for all I know, I might agree with him...but he does himself few favours in how he goes about it.
