I'll hazard a guess she won't get 38 months. She'll probably have several character witnesses to say she was/is of otherwise good character. Her lawyer will claim undue hardship to the family, because who will look after the kids (erm, maybe the father?), and won't someone think of the poor children. If she's still on remand pending sentencing now, I reckon she'll get out and and be sentenced to tagging, curfew, community service.
Women are often treated more harshly than men by the criminal (in)justice system, but in this case it's possible her husband being a Tory councillor might still have some influence, despite the sentencing hearing being moved to Birmingham.
I am not sure about that, the magistrates court has sent she to the crown court, because they felt they didn't have the power to sentence her for long enough, which IIRC is a year in the magistrates court.
They also transferred the case to B'ham, so to avoid any basis as a result of her husband being an elected official in Northampton.
Dogsauce posted she would likely only get a slap on the wrist, and others agreed, yet that hasn't happened, the case is considered to be serious.
