Ed Sheeran v Marvin Gaye

Ah, so this is New York, which is 2nd circuit. No idea what applies there. Anything could happen... Though presumably they have a weather eye on their west coast compatriots.

Tangent... Second circuit: New York, Vermont, Connecticut. 9th circuit: California, Washington (state), Arizona, Oregon, Nevada, Montana, Idaho, Hawaii, Guam and the Northern Mariana islands. That seems fine.
 
Funny..

As the case opened, their lawyer called Sheeran's use of lyrics from Gaye's song at his concerts a "smoking gun".

But he [Ed Sheeran] said he'd "be a quite an idiot" to do that if he had copied the song.


Not an idiot, just someone who's found a neat way to grab a bit of reflected glory and never expected anyone would care. Next time, try harder .. do what Jeff Lynn did with 'Yesterday', speed it up and change the cadence and make it into 'Mister Blue Sky'
 

Sheeran said he’s heard from other singers since the trial began last week because they share his worries about litigation resulting from their songwriting. He didn’t identify any of them, but said they’re cheering him on – grateful that he’s standing up against what all songwriters view as a threat to their work.

If he lost the case he said he'd quit music, lol godz forbid you should write some riffs of your own to sing yer mawk over :thumbs: no seriously, I'm glad the applicants lost, cases like this are ridiculous. Even when they have merit they can fuck off IMO. Free music, end of story.
 
It made no sense anyway. It was four chords, played in a different key with notable differences (as well as similarities). Just like hundreds of other songs. It was the correct judgement.

If only Townsend co-wrote ‘What’s Going On’ because Sub Sub’s “Ain’t No Love (Ain’t No Use)” definitely samples part of that track. In fact Andy Williams even alludes to it in the Guardian.
