Christ this is infuriating. I've been an HR partner for 20+ years. I've been on the other side of this situation multiple times. So for the third time, do yourself a favour and take legal advice.

I've obvs had a few other things to sort out in the last couple of days as my life's kinda been upturned but if you can recommend a lawyer other than the one she has sent me details for then please send over via PM if you like?

One thing that occured to me. Will they be giving you a good reference? Worth securing that as well.

Yes there's some clause in there about the reference. But I'm deleting this sorry episode from my work history anyway and will just put this period down to 'freelancer' at various firms. I do bits on the side here and there so that's true so fuck it ill go with that. in my industry they dont really check references too closely, its just about your portfolio...

1.1 Subject always to the Company's legal obligations regarding the giving of references, the Company agrees to provide You with a reference in the terms of the letter at the schedule and agrees to respond to all employment reference enquiries in a manner consistent with this reference, provided always that all such reference enquiries are addressed to the People Team.

1.2 If the Company obtains information after the date of this agreement which would have affected its decision to provide a reference in the terms at the schedule, it shall inform You and may decline to give a reference.

As far as the 'genuine goodwill' bit I think that might be a reference to them knowing my son has been unwell and it's just before Xmas. They kind of alluded to that.

If you're in a union, ask them. (And would they help with costs?)

Yes, it has to be independent advice and it's mandatory to get the independent advice.

You don't need to go with their recommendation Petcha as Winot says. Also your lawyer can ask for an agreed reference which doesn't need to refer to you failing anything.

A short reference confirming employment dates, job title, clear disciplinary record and best wishes for the future is enough (and won't raise any red flags for future employers either).

Edit: getting an agreed reference doesn't mean you have to use it.
 
I dunno if you have any grounds for unfair dismissal... :confused: Given you're still in probation you have no rights other than these:

You're probably best trying to get one of this 15 minute freebie calls with a lawyer - or a Union.

I was in a crap situation during probation - bullying by someone in education sector. Both the Union and lawyer advised me that unless I wanted to spend 2 years of my life fighting for something that was unlikely to succeed I was best probably just resigning and moving on with life..
