I think I’ve been discriminated against

In Jan 2016 I wanted to transfer my job from London to our Nottingham depot.

I was told I had to apply from scratch for the same post again. I did so and did not make the shortlist. I was told my application was weak. However I have 15 years experience in my company and at that point was regularly praised on social media by our customers. During this time I was on medication for anxiety and the company were aware of my mental health issues.

I got wind of other employees who had transferred across between depots without any real issue. So justifiably annoyed I put in a grievance. This was not upheld and I was slapped down by our HR director who seemingly relished telling me she didn’t like the tone of my emails.

As my wife and I were buying a house in Nottingham and she had quit her job. I had to think fast so I applied for a different role at Nottingham and got that job in the August of 2016. The new role was similar, but paid about £4000 less PA. This would also mean a reduction in my pensionable pay.

The company then told me I would have to wait for the next training course. So I moved to Nottingham in November. While still working in London for 4 months and living out of hotels funded from my own pocket during that time.

This week I discovered another colleague ( let’s call him A) at London has managed to transfer over to Nottingham and is just waiting for a start date. When I asked him about this via a text, at first he said it was a transfer. Then backtracked and said hed formally applied but he’d yet to have an interview.

Another colleague (let’s call him B) who informed me of colleague A’s transfer had found out via an informal conversation with our depot manager. I asked him to confirm that he’d definitely been told that colleague A was having a transfer. He responded by text message that it was true and that is what he’d been told.

I have screenshots of all these conversations.

I’ve requested to know more from my union rep. But he’s yet to respond. I feel fucking outraged. Hurt and also very inadequate. There’s always been a culture of favouritism in my company. But the period of July 2015-May 2017. I was under medication for stress and anxiety. I feel the company made my wish to move to Nottingham as difficult as possible, in order to drive me from the business. I think this is down to me raising concerns over my working roster at London, and also raising safety and operational concerns on a regular basis.

Any advice appreciated. I’m in a really bad place.
 
Hmm, if you've asked for re-deployment and also had medical issues, should you not be allowed early access to potential internal job openings. That's how it works here.

the first thing i'd do if someone came to me as their union rep with your story would be to advise them to get all the documentation together. if you can, do that this weekend. get onto the company website and intranet and download all the policies which you feel may be relevant and go through them to see where the company may have fallen short. email your union rep on monday, even if you've not heard back, and tell them what action you've taken in advance of a meeting, and request a meeting as soon as possible.

going on my experience as a union rep i would ask you to complete a case form (unison, may be different with you). with unison you need to complete a case form which goes through the branch to the region for referral to a union-funded solicitor. ask your union rep about their procedure for getting legal advice and support from a solicitor. e2a: it's the same thing for tribunals afaik, although things may have changed after the recent court case. but go through the union for access to a solicitor asap.

see what you can get to confirm what you've been told about your colleague, so you can confirm there have been no misunderstandings.
