RIP Dalian Atkinson

Chances of pension being stripped?
Because it's a serious offence committed in connection with his duty, the force can apply for a certificate from the Home Secretary; if she decides that his conduct is liable to lead to a serious loss of confidence in the police, he can be stripped of his pension (or at least the 65% of contributions made by the force). Hard to see how a criminal homicide whilst on duty wouldn't undermine public confidence, but nothing Priti Patel does would surprise me!

Following the jury’s verdict, Dalian’s family made the following statement: “Dalian Atkinson is much missed by all his family and friends and the footballing communities of the clubs he played for in his long and successful career as a professional footballer, especially Ipswich Town, Sheffield Wednesday and Aston Villa.

The past five years have been an ordeal for Dalian’s family.

We knew years ago about the terrible injuries inflicted by PC Monk on Dalian, but have been unable to talk about them due to the criminal process. We are hugely relieved that the whole country now knows the truth about how Dalian died.

While it has been hard for us not to be able to talk about the details of Dalian’s death, it has been even harder to sit through this trial and to hear PC Monk try to justify the force he used.

On the night he died, Dalian was vulnerable and unwell and needed medical attention. He instead received violence, and died with PC Monk’s boot lace prints bruised onto his forehead.

We have been sickened to hear PC Monk try to minimise the force he used on Dalian and exaggerate the threat he posed. Fortunately, the jury has seen through the lies and the pretence. We would like to thank the jury members for all their hard work and attention.

The fact that this case has taken nearly five years to get to trial is completely unacceptable, especially when you consider that PC Monk’s identity was known to the prosecuting authorities from Day One.

By contrast, the murderer of George Floyd was convicted less than a year after his death. Our system for prosecuting police officers must work better in future to get rid of these unjustifiable delays. No more excuses – no more delays.

I hope he has that sugar and boiling water thing they showed on 'time' done to him on a regular basis

How the fuck was this not murder?

Murder requires intent to kill. Obviously what the cop did was horrific but intent to kill is hard to prove. He definitely intended to hurt him badly but presumably the jury had reasonable doubt as to intent to kill.

Eta I'm not expressing an opinion on the verdict here, just saying what the law is as I understand it.

Kicking the fuck out someone's head as they lay unconscious? Its action that's carries a very high probability of causing death. It's up there with stabbing someone really.
If it was anyone other than a cop it would be nailed on murder.

it amazing it was manslaugter in the way this sort of cases normally go,

also with a barrister

you forget police court experience and his now ex missus as back up saying how terrifying Dalian was

not expected charges against the other pc even with repeated baton strikes whilst he was getting kicked in the forehead

Murder doesn’t need intent to kill, just to cause serious harm, (GBH).

Yes and the victim's vulnerability is not a defence. So all the stuff about Atkinson's medical conditions should not have been raised at all. Although of course he was already on the brink of death at the time his encounter with the police but also a terrifying superhuman killing machine who, in defiance of the known laws of physics, was impervious to repeated jolts of high-voltage electricity.

It's hard to see how you could kick an already unconscious man in the head repeatedly without the intent to cause him serious harm. But I guess that's part of the problem of leaving the jury the alternative verdict of manslaughter; the temptation is to compromise on that.

I'd not seen this before:

But Karen added: “The police told us they had Tasered him and I said, ‘Why have you Tasered a poorly man?’ One of them sat on the sofa leant forward, showed his baton and said, ‘It was either the Taser or the tickle stick’. Then a copper came in and said, ‘Dalian has been taken to hospital, he’s gone into cardiac arrest and we’ve not been able to resuscitate him’. I just fell on the floor. We were all in shock.”
 :(

Karen disclosed Atkinson successfully complained to the police watchdog over his treatment in a roadside stop three years before his death and slammed the callous conduct of officers.
The former Villa ace's 2013 police complaint related to officers arresting him after he failed to give his name when he was stopped in Shrewsbury.
Karen said: “He was just a black man in a Mercedes and he was taken to the police station. He was poorly treated – he felt he had done nothing wrong and he thought it was excessive. He lived with that through his entire life.”

Thanks for this list. And yet they still fail to arrest the tyrants and war criminals. And spend all their time kettling democracy activists. I remember contacting the film director Ken Faro of "Injustice" for an interview when I worked at TV Tokyo in London but it didn't happen in the end.

Time for a thorough Truth and Reconciliation Commission to sort out this mess.

Dalian Atkinson killing: officer was kept on despite gross misconduct

"The police officer convicted of the manslaughter of Dalian Atkinson had been previously found by a police disciplinary hearing to have committed gross misconduct but was allowed to remain an officer and given a stun gun, it has been revealed."

This is an odd one, he failed to disclose two cautions when he applied for the piggery, one was drunkenness which is fine, as is it seems violence, but his other caution was for theft from his employers (Woolies), normally offences involving dishonesty are taboo for the 5-0.
