Advice please regarding non payment

Hi All,

I'm contracting and this month ( Dec ) I was only paid for 2 of the 4 weeks I did in December.

One of the weeks I admittedly sent in a time sheet a bit late so I completely accept that I wont get paid for that.

This is where it gets a bit complicated. I sent off my time-sheets on time for the other weeks pay, the agency sent over the time-sheet to the company I'm contracted to but the bloke there had changed his email address but didnt create a forwarding rule, so by the time he checked his old emails and approved it it was after the agency cut off date.

After quite heated phone calls last week i was told payroll would be open today, however checking my emails i got an email late last night from the agency that they wont pay it until 21/01 which has properly screwed me up for next months rent, as it was a client error , am i within my rights to refuse to go back in until they sort this out ?

or do i have any other options ?

Thanks in advance

ruffneck23 - hope you got this sorted out, eventually.

This might be a bit late, sorry ... but hth.

I would have thought that you should still get all of your money, just a bit later than expected.

As for the rent problem, mutter in you landlord's ear that your pay is late because of some communication problems. Should be OK if you've been paying on time up to now.

Personally, when I was working to weekly timesheets, I used to get a regular basic / minimum weekly amount and all the extras paid a lump the first week of the following month (hours, expenses etc).

Ask for advance due to their fuck up

Thanks for the replies, it kind of got sorted out, as I went to the people I work for who agreed that if i didnt get something I wouldnt come into work until i did.

They then went back to the agency, and a compromise was met so I got paid for one of the weeks on Friday , luckily the people im lodging with were pretty cool , in fact far less stressed out about it than I was.

So I've pretty much paid my rent ( well 3/4 )and will now get paid the rest next Friday.

Its still pretty shit of the agency who were not going to budge until I got my work to kick off.

OH does a lot of supply teaching, but most of the agencies are OK for pay and expenses. One can be a bit problematical, but it works out in the end - still works through them as their base rate is a bit better.
Although the main bugbear is the lack of geographical awareness of some agencies - it takes time to drive any distance in Northumberland - it is big county and if the journey is into or past the tyneside conurbation you need to add extra for the congestion.

Yeah this agency have been pretty disgraceful from day one , they didn't have a clue about the Isle of Man and work permits etc, lied about the job and then this latest load of bullshit.still contracts up on 3rd March , time to come home and find something else with a different agency , but now with hindsight of how to deal with agencies in future
