Don't know much about this but thought we could all do with some good news :)

The Poznań District Court acquitted four anarchists, previously convicted of attacking policemen. The incident was supposed to take place during the Black Protests in 2016. However, the court found that the collected evidence was not sufficient to clearly and evidently prove guilt to the accused. - This case failed as far as evidentiary proceedings are concerned - judge Dariusz Śliwiński said.
The District Court in Poznań issued a judgment in this case on Thursday, September 24. He decided to acquit all those convicted in the earlier anarchist proceedings. Then Małgorzata C., Jacek S. and Joanna M. heard a sentence of 10 months restriction of liberty by performing unpaid community work. In turn, Maciej H. heard the sentence of the year of restriction of freedom by community service. Two other people were acquitted. Anarchists were accused of attacking police officers during the Black Protest in October 2016.
He added that in Polish law, wine must be proven beyond any doubt and individually. Collective liability cannot be applied to the accused. This was not the case.
- One can get the impression that the District Court in the proceedings in the first instance did not use all the evidence. He focused on that coming from the police and the participants of the incident, and beyond his attention were objective evidence and expert opinions - explained judge Śliwiński.
In issuing this judgment, the court focused on audio-video recordings. As he stated - in the case of Małgorzata C. , who was accused of, inter alia, throwing flares, this material does not indicate that she did so. The judge individually discussed the case of each of the accused.
Joanna M. was accused of, for example, stopping a police car. The judge found that after seeing the recordings and photos, it was difficult to uphold this allegation.
“She was in front of the car and on the hood, but rather because there was general confusion. It is difficult to say that this behavior had the purpose that was attributed to the District Court. You also need to show your intention
the judge explained.
As for Małgorzata C. and Jacek S. , they were attributed, inter alia, hitting and kicking policemen during arrest. However, the recordings show the confusion again, there are no attempts to attack them, and the testimony of one of the policemen showed that he did not know whether the kick was intentional.
- Then you can see how the policemen take these people out. However, here too, the ability to kick or punch had to be limited, given that each was held by four officers - two by the hands and two by the legs...the judge said.
As for the fault of Maciej H. , he explained: - There are at least three or four versions of what happened to you, two of which are mutually exclusive. You can't prove anything this way.
The judgment of the earlier proceedings was appealed against by the accused and their lawyers. The judgment in the appeal proceedings issued on Thursday is final.
The innocent people did not hide their joy at this turn of events. The first signs of it were already visible in the courtroom, and in front of the courthouse, several people greeted them with applause.
- Such decisions restore my faith in such matters. When citizens are faced with police testimony and have to prove they are innocent. It is always difficult. The court has shown courage today
- said lawyer Agnieszka Rybak-Starczak , a defender of anarchists after the hearing.
Let us recall that in October 2016, the Black Protest against the tightening of the anti-abortion law took place at Adam Mickiewicz Square. About 10,000 people participated in it. people. After the demonstration, some people (around 1,000) went to the PiS office at ul. Saint Martin. There were flares, smoke candles. There were also scuffles between the protesters and the policemen.
However, the assessment of these events was completely different on both sides. The policemen from the very beginning argued that their intervention was necessary, and the anarchists themselves accused them of exceeding their powers and using force for no reason.
On the day of the protest, three people were detained, six were accused in total. The part is about violating the personal integrity of policemen by kicking, pushing or shoving them, and the part about participating in an illegal gathering.
