Witness Appeal: Serious Assault, Oxford Street Mar 9th

You work your arse off, save enough cash to do a course and now possibly £5K in legal bills plus criminal record? That's tough...

it seems that not only is a taxi driver getting away with attempted murder, but perversely, the victim is getting charged with assault.
the victim is a friend of mine. please circulate this as he doesn't deserve any of this.

What a terrible story. Hope your mate's OK.

Paste it on a bike blog thread on the guardian, too, and here:

and I'd get the mayor's office on the case, too. they'll likely be wary of a case in progress.

Fucking CCTV - never there when you need it.

Er, wut?

Jared's blog said:
...the subsequent investigation failed to retrieve CCTV footage before it was erased and also failed to secure the details of a witness who saw the entire incident, and who looked after me throughout and assured me and the police he would be my witness. The police now have no record of his details.

Oxford Street? Possibly one of the most densely populated and CCTV'd places on earth? You have to be kidding me.

At a guess, because eligibility for Legal Aid depends on capital/savings as well as income. He says he's saved enough to fund giving up work so he can write full time and was planning a research trip abroad. Unfortunately, it doesn't matter that he's earmarked the money - it still counts as funds available to him for Legal Aid purposes.

I can't see a conviction here. It has to be beyond all reasonable doubt.

No witnesses on either side, medical evidence to support your friends version . . .

What a fucking crock of shit. Why is he having to canvass the nearby shops for CCTV footage? Isn't that what the Police are paid to do? Especially if the CPS try to build a case against him?

I hope it gets sorted for him and the cabbie gets sent down. Fucking wanker.

I hope it works out for your friend. I had both arms and a foot broken by a taxi driver who knocked me off my bike in an open-and-shut case two years ago now. It's still ongoing (thanks to blank denial on her part, a smart solicitor, and a ruthless ability to challenge every minor cps error - of which there were many).

My experience is that in such a situation you have to do most of the cps work yourself, and don't assume that they have (or can avoid mislaying) anything at all of relevance to the case. I've had to give them the witness details, provide blown-up colour photos of the scene in triplicate, etc etc just to stand a chance of getting justice (or at least 4 penalty points and a small fine).

It won't help your friend, but my advice to any witnesses to accidents like this out there is to give your details to the police sure, but then SLIP A PIECE OF PAPER WITH YOUR DETAILS ON TO THE CYCLIST. Stick it in their rucksack or pocket, even if they're groggy or in shock. It may be vital, as it was in my case.

Hope it works out for your mate. What a cunt. All these people in Oxford Street and not a single fucking witness?

All I know is that I see far more cyclists break the law every day with how they act on the streets than I ever do Taxi drivers so based on that I would be willing to give the Taxi driver the benefit of the doubt.

Were you born a complete and utter cunt or did you have to practice at it?

How many people perish under the wheels of bicycles annually compared to, say, cars?

I like to think it comes naturally.

But why are people so keen to assume that this cyclist is telling the truth ? Thats the bit I am failing to understand. Perhaps its because I am a working class londoner and know a few Taxi drivers that I tend to believe that there is more to this story than meets the eye but I accept that this is also probably down to a prejudice I have about cyclists in general.

Whats your excuse ?

it happened to a friend of mine who i believe cos he's not a lying snivelling shit.

Does/did the taxi driver have any say in whether these charges are pursued?

From what I have read this is all about the CPS deciding to charge him. Which means that they must be confident of getting a conviction.

Still its a London Taxi Driver who has had to study for years to get his licence, has to have his taxi insured and kept in a mechanaically good state and who has to be vetted by the Police so its automatic that he is the bad guy in all of this.

i'm vouching for him. he's an honest and thoroughly nice person. one of the good guys.

this man lost his temper and tried to throttle someoneone. he's also a racist fuck. so he deserves to lose his license. i wouldn't want someone that volatile ferrying ther public about.

Don't be silly. The cyclist is a FRIEND OF THE OP.

What bearing does any of this have on the likelihood he has a tendency to violence and racism? None whatsoever.

So, according to Stoatie...

Cyclists are bad
Taxi drivers are good
Stoatie's working class so therefore knows some taxi drivers

Erm, any other slightly random points we can glean?
